A report released by the state about the Centers for Medicare and Medicaid Services (CMS) on Monday cited Yorkville Endoscopy for several insufficiencies related to the 81-year-old comedienne’s case. The comedienne's death was classified as a therapeutic complication.
As a result of the state investigation, the federal Department of Health and Human Services has given Yorkville Endoscopy until Jan. 7, 2015 to correct shortcomings to steer clear of losing accreditation for the government’s Medicare program covering the elderly.
TMZ shared the news regarding the alleged mistakes that led to the comedienne's awful end on Twitter.

THR also reported that had a history of acid reflux and was suffering of harshness prior to her scheduled esophagogastroduodenoscopy (EGD). However, the report shows that she underwent another procedure called a nasolaryngoscopy. It was said that it was performed twice by an ENT doctor, who was unlicensed to perform procedures in the Yorkville area. Allegedly, Rivers never gave permission to that procedure.
The state report said that the Manhattan clinic “failed to identify deteriorating vital signs and provide timely intervention” in Rivers’ case. The report also contains a list of violations made by the doctors and the staff at the clinic.
Rivers' daughter, Melissa, reportedly retained the well-known Manhattan personal injury firm Gair, Gair, Conason, Steigman, Mackauf, Bloom & Rubinowitz for a lawsuit against the clinic and the doctors who operated on Rivers. It is anticipated to be filed in the next month.
If the doctors and another staff at the Yorkville clinic have followed the rules and regulations ,our beloved Rivers could have been with us today. Prompt action should be taken against all the authorities involved in such blunder to avoid further tragedies.
