‘NCIS’ Recap: ‘Day in Court’

“NCIS” Season 13 Episode 9 “Day in Court” aired last Tuesday, Nov. 17, 2015 at 8:00 p.m. on CBS. In this episode, the NCIS team agreed to reopen an investigation into a petty officer accused of murder after he turned himself in to be court martialled. Meanwhile, NCIS Special Agent Eleanor “Ellie” Bishop (Emily Wickersham) confronted her husband about why they had been so distant as of late.  Read on to learn more about this episode.

The episode opened with Petty Officer Kyle Friedgen (Kelly Blatz) being released by the courts. It was after he was accused of killing his ex-girlfriend, Joy Vanatter. Afterwards, his wife, Hanna Friedgen (Erinn Westbrook) decided to leave him, although she was expecting in three week’s time.

Afterwards, Attorney Carrie Clark (Salli Richardson-Whitfield) called NCIS Special Agent Leroy Jethro Gibbs (Mark Harmon) and asked him to grant Kyle’s favor of turning himself in to be court-martialled so that the world would finally believe that he did not kill Joy, as everyone, including his peers at work, thought that he had murdered her. However, he claimed that the evidence that had been tossed out in the recently concluded trial, a syringe with Joy’s blood in it, had been planted.  It had been tossed out as States Attorney Alan Wyner  (Tug Coker)hadn’t signed the warrant before their detectives searched Kyle’s car.

Because of this, Gibbs had NCIS Special Agent Timothy “Tim” McGee (Sean Murray) and NCIS Special Agent Anthony “Tony” DiNozzo, Jr. (Michael Weatherly) go to Baltimore in order to get hard copies of the police report and the physical evidence used in the trial. There, Tony was welcomed warmly as he used to work there.

Meanwhile, NCIS Special Agent Eleanor “Ellie” Bishop (Emily Wickersham) and NSA Attorney Jake Malloy (Jamie Bamber) went on a nice date together, but Jake refused to tell Ellie what had been going on. However, the next day, when she tried to surprise Jake at the diner they used to have lunch together at, she saw him in a heated discussion with one of NSA’s Internal Affairs agents, Taylor Matthews (Lindsey McKeon). Piecing two and two together, Ellie began to suspect that Taylor was reprimanding him. It seemed like he was being accused of knowing ahead of time about the attack on them. She then had Forensic Specialist Abby Sciuto (Pauley Perrette) pull up the archived taxi dashboard camera footage that had been used to see if Jake was alright, and she saw that he had been with Taylor.

While all of this happened, Tony managed to track down an old confidential informant. He told Tony and McGee that Joy usually bought high-grade heroin and that she had seen a rich guy in a suit as of late.

The investigation then took a turn for the worse after Abby discovered that Kyle had lied to them about never meeting up with Joy, as he had withdrawn some money and had given it to her. However, after being questioned about it, he claimed that he gave her the money so that she wouldn’t tell his wife about their past relationship.

Later that night, Ellie went over to Gibbs’ house to ask for some advice, as Jake was out of town due to work.

The next morning, Ellie confronted Jake and discovered that her initial suspicions had been right and that Jake was indeed having an affair with Taylor. He then tried to talk to her at work, but the men quickly got him out of the building.

Meanwhile, Abby and Dr. Donald “Ducky” Mallard (David McCallum) discovered that something was off as the syringe that had been used as evidence told them that Joy had been using low-grade heroin. However, their autopsy suggested that she was using high grade heroin, which meant that Kyle might have been telling the truth.

They then got the syringe that had been used to bust Joy before, and after testing it, it was discovered that the syringe was clean, and that it had been accessed by none other than States Attorney Alan Wyner. It led them to believe that he had switched the syringes, and that he had planted the evidence in Kyle’s car, as he had been the one sleeping with Joy. This, of course, if it got out, would impact him negatively if ever he wanted to climb the political ladder.

Afterwards, Ellie decided to go to her parents’ home in Oklahoma for the meantime in order to get some space, and so that she could think about what her next steps would be.
